How do I obtain TSCA certification in the United States? What products require TSCA certification?
On January 6, 2021, the U.S. Environmental Protection Agency (US EPA) published rules in the Federal Register for five persistent, bioaccumulative, and toxic (PBT) substances, 40 CFR 751.401-751.413. These rules establish control requirements for five PBT substances: DecaBDE (decabromodiphenyl ether), PIP (3:1) isopropylated triphenyl phosphate), PCTP (pentachlorothiophenol), HCBD (hexachlorobutadiene), and 2,4,6-TTBP (2,4,6-tri-tert-butylphenol). These requirements took effect on February 5, 2021, and will be effective on March 8. The TSCA process will be implemented gradually.
TSCA Process:
1. The company prepares product information for the testing agency.
2. The testing agency conducts sample evaluation and provides a quote.
3. The company completes an application form and mails the samples to the testing agency.
4. Both parties sign a contract.
5. The testing agency arranges testing.
6. Upon completion of the test, the testing agency issues a draft report to the company for approval.
7. The turnaround time is 5-7 business days, including sample separation and testing time.
I: Which products require TSCA?
Actually, most products require TSCA. Therefore, only products not regulated by TSCA are accepted here: tobacco and tobacco products, nuclear materials, munitions, food, food additives, pharmaceuticals, cosmetics, and substances used solely as pesticides. This means that, aside from these products, all other products using chemicals must undergo TSCA. When chemicals are part of imported articles, a TSCA declaration is not required.
II. The main uses and control requirements of these substances are as follows:
Decabromodiphenyl ether (DecaBDE) CAS No. 1163-19-5: A flame retardant used in plastic casings of wires and cables for televisions, computers, audio and video equipment, textiles and upholstered items, communications and electronic equipment, and other applications;
Triphenyl isopropylated phosphate (PIP (3:1)) CAS No. 68937-41-7: A plasticizer, flame retardant, anti-wear additive, or anti-compression additive in hydraulic fluids, lubricating oils, lubricants and greases, various industrial coatings, adhesives, sealants, and plastic products;
Butylphenol (2,4,6-TTBP) CAS No. 732-26-3: A processing intermediate/reactant incorporated into formulations for fuels and fuel-related additives;
Pentachlorothiophenol (PCTP) CAS No. 133-49-3: A chemical used to make rubber more flexible in industrial applications;
Hexachlorobutadiene (HCBD) CAS No. 87-68-3: A chemical substance used as a halogenated aliphatic hydrocarbon, produced as a byproduct in the production of chlorinated hydrocarbons.
Testing allows for selective testing of the substance based on the material, saving testing time and costs.
